This document outlines the Terms of Service for KepFai for business customers, covering how the service is delivered, customer responsibilities, where data lives, and how the service is wound down.
The binding agreement is the per-customer contract signed between TecTony Co., Ltd. and the customer before go-live. Where this document conflicts with that contract, the contract controls.
Service provision and delivery model
KepFai is an automatic LINE-chat archiving service for Thai businesses, built and operated by TecTony Co., Ltd. Each customer receives a dedicated deployment on the customer's own Cloudflare account and their own domain — KepFai is not a multi-tenant SaaS. The service includes connection of the customer's LINE Official Account, integration with the customer's storage (Google Drive, OneDrive, or NAS), and initial configuration.
Licence and usage rights
TecTony grants the customer a non-exclusive, non-transferable licence to use the KepFai software for the customer's internal business purposes, for the term specified in the contract. All copyright, intellectual property, and other rights in the software remain with TecTony. The customer may not copy, reverse-engineer, modify, or resell the software.
Customer responsibilities
The customer is the owner of the LINE Official Account, the storage account, and all data archived through KepFai. The customer is responsible for obtaining LINE OA approval, notifying chat members about the archiving in accordance with Thailand's PDPA, and establishing a lawful basis for the processing. The customer must also safeguard admin/owner credentials, including passwords and the mandatory TOTP 2FA enforced on every account.
Data storage and location
Files and content archived through KepFai are written only to the customer's own storage (Google Drive, OneDrive, or NAS via Cloudflare Tunnel). TecTony does not retain files on our servers and does not access customer files except on the customer's request for technical troubleshooting. Operational metadata (chat records, upload logs, audit logs) live in a Cloudflare D1 database under the customer's own Cloudflare account.
Fees and payment
Fees, pricing, and payment terms follow the per-customer quote and contract — KepFai is not a self-serve SaaS and there is no list price. NAS support via Cloudflare Tunnel carries contract-tiered pricing reflecting the additional integration work. Changes to scope or add-ons require written agreement.
Termination and data return
On termination, TecTony will decommission the customer's Worker and disconnect from LINE and the storage backend per the procedure set out in the contract. Data residing in the customer's storage, the customer's D1 database, and the customer's Cloudflare account remains under the customer's control. The customer can download, retain, or delete that data at their discretion.
Limitation of liability
TecTony provides KepFai with reasonable professional care but does not warrant that the service will be defect-free or available without interruption. Liability is capped as set out in the contract and excludes indirect damages, loss of expected profit, and force majeure. The customer acknowledges that KepFai is a tool that supports PDPA compliance — not a legal certification.
Governing law and dispute resolution
The Terms and the binding contract are governed by the law of the Kingdom of Thailand. Disputes are addressed first through good-faith negotiation; failing resolution, the courts of Bangkok have jurisdiction. Where the Thai- and English-language versions diverge, the Thai version controls.
